These Terms & Conditions (the “Terms”) govern your access to and use of the OFF-LEASH Indoor Dog Park & Social Club facility, services, website, and any related products or programs (collectively, the “Services”) provided by [OFF-LEASH Indoor Dog Park, LLC] (“OFF-LEASH,” “we,” “us,” or “our”). By accessing our facility, using our website at www.offleashindoor.com (the “Site”), making a reservation, purchasing a membership, or participating in any related Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Services.

1. Eligibility & Account Information

1.1 Age Requirement

You must be at least 18 years old to create an account, purchase Services, or sign any waiver on behalf of yourself or any minor guests.

1.2 Accurate Information

You agree to provide accurate, current, and complete information when creating an account, purchasing memberships, booking services, or submitting any forms (including waiver forms, reservation forms, and contact forms), and to update such information as needed.

1.3 Account Security

You are responsible for maintaining the confidentiality of any login credentials associated with your account and for all activities that occur under your account. You agree to notify us promptly of any unauthorized access or use.

2. Facility Use, Rules & Waiver

2.1 Waiver Requirement

All human guests must sign our General Liability Waiver & Terms of Service Agreement prior to entering the OFF-LEASH facility or participating in any OFF-LEASH Services. No exceptions.

2.2 Health & Vaccination Requirements

All dogs must meet OFF-LEASH’s current health and vaccination requirements as stated on our Site and/or in our waiver, including but not limited to current rabies, Bordetella, and distemper (DA2PP or DHPP) vaccinations and any spay/neuter requirements. You are responsible for providing accurate documentation and for keeping your dog’s records up to date.

2.3 Behavior & Safety

Only social, non-aggressive dogs are permitted at OFF-LEASH. OFF-LEASH reserves the right to refuse entry, suspend access, or permanently remove any dog or person whose behavior we determine, in our sole discretion, to be unsafe, disruptive, or inconsistent with our rules and community standards.

2.4 Rules of Conduct

All guests must follow OFF-LEASH’s posted and published rules, including but not limited to:

Supervision of your dog at all times.

Compliance with staff instructions related to safety and conduct.

Leashing requirements when entering and exiting the facility.

Prohibition on outside food, treats, or toys in designated off-leash areas (except as approved by staff).

2.5 Assumption of Risk

By entering the OFF-LEASH facility or using our Services, you acknowledge that dog-related activities carry inherent risks, including but not limited to dog fights, bites, scratches, illness, injury, and property damage. You voluntarily assume all risks associated with your presence and your dog’s presence at OFF-LEASH, whether caused by your dog, another guest’s dog, or any other person or condition at the facility.

2.6 Release of Liability

To the maximum extent permitted by law, you release OFF-LEASH, its owners, employees, contractors, agents, and affiliates from any and all claims, demands, damages, or causes of action arising out of or in connection with your or your dog’s participation in the Services, except to the extent caused by our gross negligence or intentional misconduct.

3. Memberships, Reservations & Payments

3.1 Memberships & Pricing

OFF-LEASH offers various membership options, day passes, daycare, spa services, events, and other offerings, each with its own pricing and terms as described on the Site or in our marketing materials. We may modify our pricing, membership tiers, or available Services from time to time at our discretion, subject to any notice requirements under applicable law.

3.2 Billing & Auto-Renewal

Where applicable, membership or subscription fees are billed on a recurring basis (e.g., monthly) to the payment method you provide at checkout. Unless otherwise stated, memberships automatically renew at the then-current rate until canceled in accordance with our cancellation policy. You authorize us (and our third-party payment processors) to charge all applicable fees and taxes to your payment method.

3.3 Cancellations & No-Shows

Cancellation policies for reservations, memberships, events, daycare, and spa services are posted on the Site, within your booking flow, or in your confirmation communications. You are responsible for reviewing these policies prior to booking. We reserve the right to charge applicable fees for late cancellations or no-shows.

3.4 Refunds

Except as expressly set forth in these Terms or required by law, all fees paid to OFF-LEASH are non-refundable. Certain programs or promotions may have additional, more specific refund terms, which will be communicated to you at the time of purchase.

3.5 Payment Processing

Payments may be processed by third-party providers such as Stripe or other payment processors. By submitting payment information, you authorize the use of such third-party processors and agree to their respective terms and privacy policies. We are not responsible for errors or security breaches arising from the systems of such third parties.

4. Events, Promotions & Third-Party Offerings

4.1 Events & Special Programming

OFF-LEASH may host events, classes, or special programming (collectively, “Events”) on-site or off-site. Additional terms or waivers may apply to certain Events. We reserve the right to modify, reschedule, or cancel any Event at our discretion.

4.2 Promotions & Discounts

Promotional offers, memberships, discounts, and referral programs are subject to change and may be modified or discontinued at any time, subject to applicable law. Any misuse of promotions or discounts (including attempts to circumvent stated eligibility criteria) may result in the adjustment of charges and/or termination of your access to our Services.

4.3 Third-Party Services

From time to time, we may refer you to or integrate with third-party service providers (e.g., booking platforms, partner trainers, photographers, or vendors). OFF-LEASH is not responsible for the acts, omissions, or services of any third-party providers and makes no warranties or guarantees regarding their services.

5. Website Use & Intellectual Property

5.1 Site License

Subject to these Terms, OFF-LEASH grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use only.

5.2 Intellectual Property

All content on the Site and within the Services, including logos, trade names, trademarks, service marks, images, graphics, copy, and other materials, is owned by or licensed to OFF-LEASH and is protected by intellectual property laws. You may not copy, modify, distribute, publish, or create derivative works from any such content without our prior written permission.

5.3 User Content

If you submit, upload, or share any content (including but not limited to reviews, photos, videos, or testimonials) with OFF-LEASH or tag us on social media, you grant OFF-LEASH a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content in any media in connection with our business and marketing, subject to any separate agreements we may enter into with you.

6. Communications (Email, Phone, and SMS)

6.1 General Communications Consent

By providing your email address or phone number to OFF-LEASH (including via our Site, reservation forms, waiver forms, contact forms, social channels, or in-person at the facility), you consent to receive communications from us related to your account, reservations, Services, and other operational updates, which may include email, phone calls, and SMS/text messages.

6.2 Operational vs. Marketing Messages

We may send you:

Operational messages (e.g., booking confirmations, schedule updates, account notices, safety alerts, or policy changes); and

Marketing messages (e.g., promotions, event invitations, membership offers, and general updates about OFF-LEASH).

You can opt out of marketing communications as set forth below, but we may still send you non-promotional, transactional, or operational communications as permitted by law.

7. SMS Marketing Program

This section describes OFF-LEASH’s SMS/text messaging (“SMS Program”) terms and conditions and applies when you opt in to receive marketing or informational text messages from us.

7.1 Program Description

By opting in to OFF-LEASH text messages, you agree to receive recurring SMS/text messages from OFF-LEASH related to:

Promotions, discounts, and special offers;

Event announcements and reminders;

Membership updates and perks;

Reminders or follow-ups related to reservations, daycare, spa services, and other Services; and

General updates about OFF-LEASH’s club, operations, and community.

Message frequency may vary but may include multiple messages per week, depending on your engagement with OFF-LEASH and ongoing promotions.

7.2 Opt-In Consent

You may opt in to the SMS Program by:

Checking an SMS consent box on a form or checkout page;

Submitting your phone number through a web form that clearly references SMS/text updates;

Texting a designated keyword to our SMS number (if offered); or

Otherwise providing express consent through an OFF-LEASH-managed opt-in mechanism.

By opting in, you confirm that you are the owner or authorized user of the phone number provided and that you are permitted to receive text messages at that number.

7.3 Opt-Out Instructions

You may opt out of marketing texts at any time by replying STOP to any message you receive from us or by contacting us at info@offleashindoor.com or (435) 999-2006 and requesting removal from our SMS marketing list.

After you send STOP, we may send a confirmation text that you have been unsubscribed. You understand and agree that opting out of marketing texts does not necessarily stop operational or transactional messages (such as booking confirmations or critical service alerts), where permitted by law and necessary for the Services you use.

7.5 Message & Data Rates

Message and data rates may apply to all SMS/text messages sent to or from OFF-LEASH, depending on your mobile carrier’s plan. OFF-LEASH is not responsible for any charges imposed by your carrier or for any delays, delivery failures, or other issues arising from your mobile service.

7.6 Supported Carriers & Service Availability

SMS delivery and availability may vary by carrier and location. Participation in the SMS Program is not a condition of purchasing any OFF-LEASH products or Services. OFF-LEASH and the mobile carriers do not guarantee timely or successful delivery of messages.

7.7 Privacy & Data Use

We collect and use your phone number, message engagement data (such as whether messages are delivered or opened), and any information you provide via SMS in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

8. Privacy Policy

9. Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, express or implied. OFF-LEASH disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site, facility, or Services will be uninterrupted, secure, or error-free, or that any defects will be corrected.

10. Limitation of Liability

To the fullest extent permitted by law, OFF-LEASH and its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any lost profits or revenues, arising out of or in connection with your use of the Services, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you for all claims arising out of or related to the Services exceed the total amount you paid to OFF-LEASH for the Services giving rise to the claim during the twelve (12) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless OFF-LEASH and its owners, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

(a) your or your dog’s use of the Services;

(b) your violation of these Terms; or

(c) your violation of any rights of a third party.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on the Site with a new “Last Updated” date and may provide additional notice as required by law. Your continued use of the Services after any such changes become effective constitutes your acceptance of the revised Terms.

13. Governing Law & Dispute Resolution

These Terms and any dispute arising out of or relating to them or the Services shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles.

Any disputes arising under these Terms shall be resolved in the state or federal courts located in Cache County, Utah, and you consent to the exclusive jurisdiction of such courts.
