By visiting, accessing, or using the services of OFF-LEASH Indoor Dog Park, LLC ("OFF-LEASH," "we," "our," or "us")—including but not limited to session-based reservations, VIP memberships, day passes, daycare, events, spa services, grooming, or any other offering—you ("Dog Owner," "User," "Guest," "VIP Member," or "Member," as applicable) agree to the following Terms and Conditions, effective February 1, 2026. These terms govern your use of our website, facilities, and services. If you do not agree to these terms, you may not enter or use any part of our property or services. This agreement serves as both a general waiver of liability and a membership/access agreement.

OWNERSHIP OF THE WEBSITE & SERVICES

The OFF-LEASH website and all content, including text, images, graphics, and branding, are the exclusive property of OFF-LEASH Indoor Dog Park, LLC. Unauthorized reproduction, modification, or distribution is strictly prohibited.

ACCEPTANCE OF RISK & LIABILITY WAIVER

By using OFF-LEASH’s facilities and services, you acknowledge and agree to the following: Dog parks inherently carry risks, including but not limited to: Dog fights, bites, scratches, or aggressive behavior. Injury to yourself, your dog(s), or others. The spread of illness, disease, or parasites. The risk of your dog becoming lost, stolen, or escaping. You assume all risks associated with your and your dog’s participation at OFF-LEASH.

ACCESS REQUIREMENTS & CONDITIONS

To access OFF-LEASH’s facilities, all users must: Be at least 18 years old to register or book. Complete the intake form, sign this waiver, and submit proof of current rabies, Bordetella, and distemper vaccinations for their dog(s). Confirm that their dog(s) have no history of aggression toward people or other dogs. Agree to supervise their dog(s) at all times and follow all posted rules, staff instructions, and session guidelines. For new users, complete a free trial session (if eligible) before paid access. Access is session-based. All users must check in, pay in full (or confirm VIP status), and adhere to capacity limits before entry.

RELEASE OF LIABILITY

You fully and permanently release OFF-LEASH, its owners, employees, and affiliates from any and all liability, claims, or causes of action related to injuries, illnesses, damages, or losses incurred at our facility, including those caused by negligence. OFF-LEASH reserves the right to request proof of vaccination at any time. Failure to provide accurate information may result in access denial, suspension, or termination without refund. OFF-LEASH reserves the right to deny or revoke access to any user or dog at any time, for any reason, at its sole discretion. This includes but is not limited to: concerns related to safety, behavior, rule violations, or failure to follow staff direction. Access is a privilege, not a guarantee.

Zero Tolerance Policy for Aggressive Dogs: At OFF-LEASH, the safety and well-being of all guests, both human and canine, is our highest priority. As such, we maintain a strict zero tolerance policy for aggressive and disruptive behavior. Not all dogs are suited for an indoor off-leash environment. Our priority is the safety and harmony of all members. Admission is subject to evaluation and can be revoked at any time. Any dog displaying aggression, repeated dominance-related behaviors toward other dogs or humans, unsafe hygiene, or otherwise disruptive behavior may be subject to immediate temporary suspension or permanent removal from the facility. All behavioral assessments and resulting decisions are made at the sole discretion of OFF-LEASH management and are final. All behavioral decisions are made at the sole discretion of OFF-LEASH staff, based on direct observation, incident reports, and/or documented patterns of behavior. These decisions are final and are made in the interest of maintaining a safe, enjoyable environment for all members. Members are expected to provide complete and truthful information regarding their dog’s temperament and behavioral history. Failure to do so may result in immediate termination of access without refund, at the discretion of OFF-LEASH management.

RIGHT TO REFUSE SERVICE

OFF-LEASH reserves the right to deny or revoke access to any user or dog at any time, for any reason, at its sole discretion. Access is not a guarantee of perpetual entry. OFF-LEASH reserves the right to refuse or revoke access if but not limited to: A dog or owner fails to follow any facility rules. A dog or owner fails to meet any OFF-LEASH community standards. A dog exhibits aggression or disruptive behavior. A dog exhibits unsafe hygiene that may result in the spreading of sickness to other dogs or people. A user provides false information about their dog’s health, behavior, or vaccinations.

BREED RESTRICTION POLICY

OFF-LEASH restricts certain breeds for safety: American Bullies, Cane Corsos, Presa Canarios, Dogo Argentinos, Wolf Hybrids, Fila Brasileiros, Tosa Inus. American Bulldogs, Mastiffs, and Pit Bull-type dogs are case-by-case based on evaluation and size; evaluations are invitation-only at OFF-LEASH's sole discretion. We reserve the right to request proof of health or behavior at any time

RESERVATION & SESSION POLICIES

Access to OFF-LEASH is primarily through 90-minute reserved sessions booked via our scheduling system. Walk-ins are permitted if capacity allows, but reservations take precedence. Capacity is limited to ensure safety and quality. Users may arrive anytime during their session window, but sessions end promptly at the scheduled time. A 30-minute reset period follows each session for cleaning and preparation; users must exit during this time and may not remain on premises. To extend into the next session, confirm availability, exit, and re-enter at the start of the next block. No-shows or cancellations within 2 hours of the session start are non-refundable. VIP Unlimited Members have priority walk-in access but must follow the same check-in process, including verification of intake, waiver, and vaccines.

FEES, CANCELLATION & REFUNDS

Session fees and daycare fees are non-refundable once processed or upon entry. VIP memberships automatically renew monthly unless canceled before the next billing cycle. Users may cancel sessions or VIP memberships at any time, but no refunds will be issued for unused time, no-shows, or partial periods. OFF-LEASH reserves the right to adjust pricing with prior notice.

BILLING TERMS

Session and daycare fees are paid in advance or at check-in. VIP membership fees are billed in advance monthly and recur on the same day each month (the "Billing Date"). A 3% processing fee applies to all credit/debit card payments to offset merchant processing costs. This fee is disclosed at checkout and included on receipts. Cash payments avoid the processing fee. Prices displayed exclude tax and processing fee unless stated otherwise. You acknowledge and agree to these additional charges upon booking or payment. It is the user’s responsibility to ensure a valid, updated payment method is on file. If payment is declined, OFF-LEASH reserves the right to suspend access until payment is successfully processed.

CANCELLATIONS

Sessions may be canceled with at least 2 hours' notice to avoid charges. VIP memberships may be canceled by the user at any time with written notice (via email or in-person) at least 7 days prior to the next Billing Date to avoid further charges. OFF-LEASH does not provide prorated refunds for partial months or unused days.

REFUNDS & TERMINATION

No refunds will be issued for any reason related to a user’s violation of OFF-LEASH park rules, policies, waiver, access agreement, or these terms & conditions. OFF-LEASH reserves the right to suspend or terminate any access or VIP membership at its sole discretion if the user, their guests, or their dog(s) violate any rules or engage in behavior deemed unsafe, disrespectful, or disruptive to the community.

PAYMENT AUTHORIZATION & CREDIT CARD ON FILE

By booking or becoming a VIP member, you authorize OFF-LEASH Indoor Dog Park, LLC to securely store your credit card on file using PCI-compliant payment systems. You consent to the automatic processing of your card for: Session fees, daycare fees, VIP monthly dues. Any applicable service fees including but not limited to: service fees, processing fees, spa, grooming, training, etc. Late fees, penalties, or other charges not outlined in this agreement may apply. You understand and agree that OFF-LEASH will provide notice before any non-recurring charges. It is your responsibility to ensure your card information is current. Failed or declined payments may result in service suspension until resolved. Any disputes regarding charges must be submitted in writing within 7 days of the billing date.

FACILITY RULES & CONDUCT

All users must adhere to the following rules while on OFF-LEASH premises: Owners are responsible for their dogs at all times. Dogs must always be on a leash when entering and exiting the facility. All dogs must be healthy and vaccinated. All dogs must meet OFF-LEASH hygiene standards. Dogs must be under voice control at all times. Owners must immediately clean up after their dogs. Dogs that display aggressive behavior must be removed immediately. Children must be supervised at all times. No outside food, treats, or toys are allowed inside the park area. Guests must comply with OFF-LEASH staff members' directions at all times. Users must exit promptly at session end and during reset periods. Failure to comply with these rules may result in suspension or termination without refund.

STAFF AUTHORITY & CORRECTIVE ACTION

OFF-LEASH staff are trained to ensure a safe and positive environment for all dogs and guests. By entering our facility, you acknowledge that our team has the right to intervene, redirect, or take appropriate corrective action if your dog displays disruptive, aggressive, or unsafe behavior. This may include physical restraining, removal from playgroups, or in rare cases, immediate dismissal from the facility.

INTACT DOG POLICY

Male dogs over 12 months of age must be neutered to access OFF-LEASH play areas. Female dogs in heat, or who are suspected to be in heat, are strictly prohibited from entering the facility and are not eligible to participate in OFF-LEASH services, including but not limited to daycare, group training, and social play. This policy is non-negotiable and strictly enforced. Any violation may result in immediate removal from the premises and potential suspension or termination of access without refund.

OFF-LEASH HYGIENE POLICY

At OFF-LEASH, the health and safety of our dogs and humans come first. We maintain strict hygiene standards to ensure a clean, safe, and enjoyable environment for every pup. Clean Dog Requirement: All dogs must arrive clean, dry, and free of fleas, ticks, or other parasites. Dogs showing signs of poor hygiene may be turned away or required to receive a bath at the spa before entry at owner’s expense. Mandatory Clean-Ups: Dogs who get visibly dirty while playing may be cleaned by our staff and owners may be charged a light grooming fee. Sick or Symptomatic Dogs: Dogs with signs of illness are not allowed in the facility and will be turned away. By entering OFF-LEASH, owners agree to uphold this hygiene policy.

EMERGENCIES & VETERINARY CARE

In case of an emergency, OFF-LEASH staff may seek veterinary care at the owner's expense if necessary. OFF-LEASH is not responsible for any medical expenses related to injuries or illnesses that occur at the facility. OFF-LEASH is not responsible for the behavior or action of any dog(s) inside the facility. Owners are ultimately responsible for controlling their dog(s) at all times. Any injury to a dog or human as a result of a dog fight is not the fault of OFF-LEASH or its employees.

PHOTOGRAPHY & MEDIA RELEASE

By entering OFF-LEASH, you grant permission for OFF-LEASH to photograph or record you and your dog for marketing, social media, or promotional purposes. To opt out, contact info@offleashindoor.com.

MODIFICATION OF TERMS

OFF-LEASH reserves the right to update these Terms and Conditions at any time. Continued use of services constitutes acceptance of revised terms.

TERMINATION OF ACCESS

OFF-LEASH may terminate access or VIP membership at any time for violations of these Terms and Conditions. No refunds will be issued for terminations.

LOST OR STOLEN PROPERTY

OFF-LEASH is not responsible for lost, stolen, or damaged personal items.

GOVERNING LAW & DISPUTE RESOLUTION

This agreement is governed by the laws of Utah. Any disputes shall be resolved in the courts of Cache County, Utah. If any portion is found invalid, the remainder shall remain in effect.
