GENERAL LIABILITY WAIVER & TERMS OF SERVICE AGREEMENT

To enter OFF-LEASH, a Park Waiver must be signed by all guests. To avoid being held up at the door, you can do this now.

OFF-LEASH INDOOR DOG PARK, LLC MEMBERSHIP AGREEMENT & GENERAL LIABILITY WAIVER

By visiting, accessing, or using the services of OFF-LEASH Indoor Dog Park, LLC ("OFF-LEASH," "we," "our," or "us") including but not limited to membership-based access, day passes, park reservations, events, spa services, daycare, or any other offering, you ("Dog Owner," "User," "Guest," or "Member," as applicable) agree to the following Terms and Conditions. These terms govern your use of our website, facilities, and services. If you do not agree to these terms, you may not enter or use any part of our property or services. This agreement serves as both a general waiver of liability and a membership agreement. You represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

1. OWNERSHIP OF THE WEBSITE & SERVICES

The OFF-LEASH website and all content, including text, images, graphics, and branding, are the exclusive property of OFF-LEASH Indoor Dog Park, LLC. Unauthorized reproduction, modification, or distribution is strictly prohibited. You authorize OFF-LEASH staff to take photos of your dog(s) for client files, advertising, marketing purposes (including print, signage, website, and social media), or operational needs.

2. ACCEPTANCE OF RISK & LIABILITY WAIVER

By using OFF-LEASH’s facilities or services in any capacity, you acknowledge and agree that dog parks inherently carry risks, including but not limited to:

  • Dog fights, bites, scratches, or aggressive behavior

  • Injury to yourself, your dog(s), or others (e.g., paw injuries, orthopedic issues, bite wounds)

  • The spread of illness, disease, or parasites (e.g., contagious conditions despite vaccinations)

  • The risk of your dog becoming lost, stolen, or escaping

  • Ingestion of materials or substrates in the environment

  • Encounters with wildlife (e.g., birds, insects) or weather-related health issues

  • Injuries from equipment, surfaces, or interactions

  • All other foreseen or unforeseen injuries to humans, dogs, or property

You voluntarily assume all such risks for yourself, your guests, your dog(s), and your property. You fully and permanently release, discharge, and agree not to sue OFF-LEASH, its owners, employees, affiliates, officers, directors, shareholders, agents, and representatives from any and all liability, claims, demands, causes of action, losses, damages, or injuries (including death) related to your use of our facilities, including those caused by negligence.

To the maximum extent permitted by law, you agree to indemnify, hold harmless, and defend OFF-LEASH and the above parties from any claims arising from your actions, your guests', or your dog(s)' behavior while on our property. This includes responsibility for any damage or injury caused by you, your guests, or your dog(s). OFF-LEASH is not responsible for lost, damaged, or stolen personal items, or for wildlife entering the premises.

Zero Tolerance Policy for Aggressive Dogs

At OFF-LEASH, the safety and well-being of all guests- both human and canine- is our highest priority. As such, we maintain a strict zero tolerance policy for aggressive and disruptive behavior. Not all dogs are suited for an indoor off-leash environment. Our priority is the safety and harmony of all members. Admission is subject to evaluation and can be revoked at any time.

Any dog displaying true aggression, repeated dominance-related behaviors toward other dogs or humans, or otherwise disruptive or concerning behavior may be subject to immediate temporary suspension or permanent removal from the facility. All behavioral assessments and resulting decisions are made at the sole discretion of OFF-LEASH management and are final.

Members are expected to provide complete and truthful information regarding their dog’s temperament and behavioral history. Failure to do so may result in immediate termination of access and membership without refund. You accept risks of communal play, including severe injury or death, and release OFF-LEASH from liability.

Right to Refuse Service

OFF-LEASH reserves the right to suspend, revoke, or refuse membership access if:

  • A dog or owner fails to provide accurate information on their New Guest Intake Form

  • A dog or owner fails to follow any of the facility/park rules

  • A dog or owner fails to meet any OFF-LEASH community standards

  • A dog exhibits repeated aggression or disruptive behavior

  • A dog exhibits unsafe hygiene that may result in the spreading of sickness to other dogs or people (e.g., fleas, ticks; dogs with fleas must leave immediately)

  • A member provides false information about their dog’s health, behavior, or vaccinations

  • A dog violates breed restrictions, age/spay/neuter requirements, or ownership rules

  • Any other reason at OFF-LEASH's sole discretion, including safety concerns or rule violations

OFF-LEASH restricts certain breeds for safety: No XL American Bullies, Cane Corsos, Presa Canarios, Dogo Argentinos, Wolf Hybrids, Fila Brasileiros, Tosa Inus. American Bulldogs, Mastiffs, and Pit Bull-type dogs are case-by-case based on evaluation and size; evaluations are invitation-only at OFF-LEASH's sole discretion. We reserve the right to request proof of health or behavior at any time.

Park Rules & Regulations

All members and guests must comply with the following rules and community standards, as detailed on our website (www.offleashindoor.com/safety). These rules may be updated periodically; continued use constitutes acceptance of changes. Violations may result in suspension or termination without refund.

Intact Dog Policy:

No intact males over 1 year old; no females in heat. This policy is enforced to minimize risks of aggression, disease transmission, and disruption, as intact dogs are statistically more prone to health issues and behavioral conflicts.

  • Intact males may be granted an extension for medical or other related reasons at the sole discretion of OFF-LEASH management, provided they submit a written medical recommendation from a licensed veterinarian or supporting documentation. OFF-LEASH may require periodic updates to verify ongoing necessity.

  • OFF-LEASH may request supporting veterinary documentation to confirm a female’s heat cycle has concluded or that she is not in heat. Any female suspected of being in heat by OFF-LEASH staff is subject to immediate removal from the park. The staff’s determination is final, regardless of actual heat status, and a veterinary consultation or recommendation may be required for re-entry. Signs of a female in heat include but are not limited to: vulvar swelling, vaginal bleeding, or excessive attraction from other dogs.

Intact dogs are subject to immediate removal from the facility at the sole discretion of OFF-LEASH staff, based on direct observation or incident reports. Staff decisions will be documented, and owners may appeal in writing within 7 days, though management’s ruling remains final. Failure to comply with re-entry requirements may result in permanent suspension without refund.

Staff Authority & Corrective Action:

OFF-LEASH staff are authorized to intervene, redirect, or take corrective action if a dog displays disruptive, aggressive, or unsafe behavior. This may include physical restraint, removal from playgroups, or immediate dismissal from the premises. These decisions are final and made in the interest of safety.

Additional Rules:

  • Guests must be the owner of the dog(s) they bring; if bringing a non-owned dog, that dog's owner must sign this waiver.

  • Maximum three dogs per owner.

  • All dogs must be at least four months old.

  • Dogs must be off-leash in play areas; only flat-buckle collars or harnesses allowed (no prong, pinch, choke, or chain collars). E-collars are allowed at the sole discretion of trained OFF-LEASH staff, provided they meet safety standards and staff guidelines (e.g., no active stimulation during play or altercation). Guests must comply with these standards. Violation results in immediate removal; re-entry requires staff approval and may necessitate collar removal or adjustment.

  • No outside food, drinks, treats, glass, or smoking (inside/out).

3. EMERGENCIES & VETERINARY CARE

In the event of an emergency, OFF-LEASH staff may seek veterinary care at the owner's expense. OFF-LEASH is not responsible for any medical expenses, illnesses, or injuries related to incidents involving dogs or guests. All responsibility remains with the dog owner.

OFF-LEASH is equipped with multiple methods to de-escalate aggressive situations between dogs, and all OFF-LEASH staff members are trained and equipped to handle fighting dogs. However, an OFF-LEASH employee will never put themselves in harm’s way during an altercation.

OFF-LEASH is not responsible for the behavior or action of any dog(s) inside the facility or any of the consequences that follow as a result of any dog(s) behavior or action towards another dog or human. Owners are ultimately responsible for controlling their dog(s) at all times. Any injury to a dog involved in a fight, or any human injured as a result of that fight, is not the fault of OFF-LEASH or its employees.

4. RESERVATION REQUIREMENTS, TERMS & CONDITIONS OF SERVICE

To access OFF-LEASH’s facilities and services, all members must:

  • Be at least 18 years old to register

  • Confirm that their dog(s) are up to date on rabies, Bordetella, and distemper vaccinations; warrant these cover limited strains and release OFF-LEASH from liability for disease exposure

  • Confirm that their dog(s) have no history of aggression and comply with breed, age, spay/neuter, and ownership rules

  • Agree to supervise their dog(s) at all times and follow all posted rules and staff instructions

  • Agree to the OFF-LEASH Terms & Conditions (available at www.offleashindoor.com/terms)

OFF-LEASH reserves the right to request proof of vaccination or health status at any time. Failure to provide accurate information may result in membership suspension or termination without refund. OFF-LEASH reserves the right to suspend, deny, or revoke access to any dog or owner at any time, at its sole discretion.

5. MEMBERSHIP & RESERVATION FEES, CANCELLATION & REFUNDS

  • All membership fees are non-refundable once payment is processed.

  • Memberships automatically renew based on the selected plan unless canceled before the next billing cycle.

  • Members may cancel at any time with written notice at least 7 days prior to the next billing date.

  • OFF-LEASH does not provide prorated refunds for partial months or unused days.

  • OFF-LEASH reserves the right to adjust pricing with prior notice.

  • Fees are charged per reservation and must be paid in full at the time of booking or upon arrival to the facility via a valid payment method.

  • Reservations are non-transferable and non-refundable once confirmed, except as noted below.

  • Cancellations must be made at least 12 hours prior to the reserved time to avoid a late-cancellation fee of 50% of the reservation cost. No-shows incur a 100% fee.

  • OFF-LEASH may suspend or terminate future reservations at its discretion for violation of rules or conduct deemed unsafe, disruptive, or disrespectful.

Billing Terms:

  • Monthly membership fees are billed in advance and will recur on the same day each month (the "Billing Date").

  • It is the User’s responsibility to ensure that a valid, updated payment method is on file.

  • If payment is declined for any active service, including but not limited to reservations, daycare, or membership renewals, OFF-LEASH reserves the right to cancel the affected service and charge a processing fee of 3% of the declined transaction amount, with a minimum of $1 and a maximum of $20.

  • OFF-LEASH may suspend access to the facility until all unpaid balances for completed services are paid in full, with a 7-day period to cure the default following notification.

Cancellations:

  • Services may be canceled by the User at any time with written notice (via email, text, or in-person form) at least 7 days prior to the next Billing Date to avoid further charges.

  • OFF-LEASH does not provide prorated refunds for partial months or unused days.

Refunds & Termination:

  • No refunds will be issued for any reason related to a guest's violation of OFF-LEASH park rules, policies, or this User Agreement.

  • OFF-LEASH reserves the right to suspend or terminate any reservation, membership, or other service at its sole discretion if the User, their guests, or their dog(s) violate any rules or engage in behavior deemed unsafe, disrespectful, or disruptive to the community.

6. PAYMENT AUTHORIZATION & CREDIT CARD ON FILE

By becoming a member, you authorize OFF-LEASH Indoor Dog Park, LLC to securely store your credit card on file using PCI-compliant payment systems. You consent to the automatic processing of your card for recurring fees and any other charges.

7. PHOTOGRAPHY & MEDIA RELEASE

By entering OFF-LEASH, you grant permission for OFF-LEASH to photograph or record you and your dog for website, marketing, social media, or other promotional purposes.

8. LOST OR STOLEN PROPERTY

OFF-LEASH is not responsible for lost, stolen, or damaged personal items, including those left inside the facility or parking lot.

9. GENERAL PROVISIONS & GOVERNING LAW

This agreement is governed by the laws of the State of Utah. Any disputes arising from this agreement will be resolved in the courts of Cache County, Utah. If any part of this agreement is found to be invalid, the remaining sections shall remain in full force and effect. No changes to this Agreement are effective unless in writing and signed by both parties. Failure to enforce any term does not waive future enforcement.
